These Terms of Use, including the end-user license terms below ("Terms", "EULA"), apply to the Luminary website and mobile application (together, the "Service" or "App"). This includes the iOS app with bundle identifier com.weiss.luminary and the Android app with package name com.schmutweiss.luminary. Provider of the Service is SCHMUT/WEISS GmbH ("we", "us").
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on a compatible device that you own or control. Your use is also subject to the rules and terms of the storefront from which you downloaded the App, either the Apple App Store or Google Play (the "Storefront").
Unless otherwise stated, texts, images, databases, features, source code, design, audio, video, graphics, and software ("Content") of the website and the App are our intellectual property. The Content is provided "as is". We do not guarantee that the Service will always function without interruption or errors. The Content may not be used by third parties without our express consent, except for positive recommendations or reporting about us, such as press coverage or social media posts.
These Terms apply to all interactions between users and us, including visiting luminarypartygame.com, communicating with us, downloading the App, and using free or paid App functionality.
The App can be downloaded and used without purchasing a subscription. Free functionality includes the Starter deck. A Luminary Unlimited subscription and optional one-time partner or sponsored deck purchases may provide additional content or features. The purchase screen in the applicable Storefront shows the product, billing period, current local price, and any other conditions before you confirm a purchase.
a) Optional subscription. Luminary Unlimited is optional. The App retains free functionality if you do not subscribe or after a subscription ends. While active, Luminary Unlimited unlocks the content and features described on the purchase screen.
b) Monthly or annual billing and automatic renewal. Luminary Unlimited may be offered as a monthly or annual auto-renewing subscription. The Storefront used for purchase charges the payment method connected to your Apple or Google account. The subscription renews automatically for the selected billing period unless it is cancelled before the renewal date shown by that Storefront. The Storefront displays the current price and any applicable taxes before purchase and at renewal where required.
c) Managing or cancelling. You must manage or cancel a subscription through the same Storefront account used to purchase it. Cancellation takes effect at the end of the current paid billing period unless the Storefront or mandatory law provides otherwise. You can manage subscriptions here:
d) Right of withdrawal for digital content. For consumers in the European Union, the right of withdrawal for digital content not supplied on a physical medium may expire once performance begins, if you have expressly consented to immediate performance and acknowledged the loss of that right, as provided by § 18 para. 1 no. 11 FAGG. Any mandatory consumer rights remain unaffected.
The App may offer optional one-time purchases for individual partner or sponsored decks. A one-time purchase is not an automatically renewing subscription. The product description shown before purchase explains the included content and access conditions. Access remains subject to the continued technical availability of the App, the applicable Storefront, and mandatory law.
Apple processes purchases made through the Apple App Store, and Google processes purchases made through Google Play. We do not directly process your payment card. RevenueCat provides product information, purchase-status, entitlement, and subscription infrastructure for the App, but RevenueCat does not process your payment card for these purchases.
The applicable Storefront determines the currency, price, taxes, payment authorization, and billing rules for your purchase. Refund eligibility and refund handling are governed by the rules of the Storefront used for the purchase and by mandatory consumer law. Contact or use the refund process of that Storefront for a refund request. Nothing in these Terms limits rights that cannot lawfully be excluded.
The contractual and business language is English.
The App retains free functionality. Optional Luminary Unlimited subscriptions and optional one-time deck purchases are subject to the price displayed by the applicable Storefront before purchase. We do not state fixed prices in these Terms because local prices and taxes may change.
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
Austrian law applies to all legal transactions, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules in your country of residence remain unaffected.
If a customer is a consumer within the meaning of the Austrian Consumer Protection Act (KSchG), the statutory rules on jurisdiction apply. In all other cases, the competent court at our registered office is agreed as the place of jurisdiction.
These Terms are concluded between you and us, not with Apple or Google. We are responsible for the App and its content, maintenance and support, subject to these Terms and applicable law. Apple and Google are responsible for their own Storefront services and purchase processing under their respective terms.
If you downloaded the App from the Apple App Store, Apple has no obligation to provide maintenance or support for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as a third-party beneficiary after you accept them.
If you downloaded the App from Google Play, your use of Google Play is also subject to the applicable Google Play terms. To the extent these Terms and the Google Play terms address different relationships, each applies to the relationship it governs.
