These Terms of Use, including the end-user license terms below ("Terms", "EULA"), apply to all interactions with Luminary ("Service", "App") in any form, including visiting luminarypartygame.com, communicating with us by email, and using the mobile app. Provider of the Service is SCHMUT/WEISS GmbH ("we", "us").
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions and the App Store Usage Rules.
Unless otherwise stated, texts, images, databases, features, source code, design, audio, video, graphics, and software ("Content") of the website and the App are our intellectual property. The Content is provided "as is". We do not guarantee that the Service will function flawlessly at all times or be provided without errors. The Content may not be used by third parties without our express consent, unless it is positive recommendations or advertising about us (for example, press coverage or social media posts).
These Terms apply to all interactions between users and us.
The contract between the customer and us is concluded when the customer downloads the App. Basic use of the App, including the free "Starter" deck, is free of charge. Additional features such as the Luminary Unlimited subscription and, in the future, individual sponsored decks are subject to a fee and are purchased through Apple's App Store as described in section 6.
a) What is included. A Luminary Unlimited subscription unlocks the full deck library and all included game modes for the duration of the subscription term.
b) Billing and auto-renewal. Luminary Unlimited is offered as a monthly and/or yearly auto-renewing subscription. Payment is charged to your Apple ID account at the confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. The account is charged for renewal within 24 hours prior to the end of the current period at the price of the selected subscription. Apple displays the current, locally applicable price at the point of purchase.
c) Managing or cancelling the subscription. You can manage and cancel your subscription at any time by going to your Apple ID account settings in the App Store after purchase. Cancellation will take effect at the end of the current billing period.
d) Right of withdrawal for digital content (EU consumers). Pursuant to § 18 para. 1 no. 11 FAGG, the right of withdrawal expires for contracts for the supply of digital content not delivered on a physical data carrier if performance has begun with your express prior consent and your acknowledgement of the loss of the right of withdrawal. By starting to use Luminary Unlimited immediately after purchase you give that express consent and acknowledge that you lose the right of withdrawal.
e) Refunds. Refund requests are handled exclusively by Apple in accordance with their App Store refund policy. You can request a refund via reportaproblem.apple.com.
Where the App offers one-time purchases (for example, a limited-time sponsored deck), the purchase grants you permanent access to that content even after the limited offer window has closed, subject to continued availability of the App and the App Store. Refund requests for one-time purchases are handled exclusively by Apple as described in section 4 (e).
All in-app purchases (subscriptions and one-time purchases) are processed by Apple via the App Store. Your contractual partner for the payment is Apple. The legally applicable currency and price for in-app purchases is determined by Apple at the time of purchase based on your App Store region.
The contractual and business language is English.
Basic use of the App is free of charge. Optional subscriptions and one-time purchases as described in sections 4 to 6 are subject to a fee.
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
For all legal transactions, Austrian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
If a customer is a consumer in the sense of the KSchG, the court in whose district the customer's domicile, habitual residence, or place of employment is located shall have jurisdiction for any legal disputes. In all other cases, the competent court at our registered office is agreed as the place of jurisdiction.
If the App is downloaded from Apple's App Store, you acknowledge that these Terms are concluded between you and us, not with Apple. We are solely responsible for the App and its content, maintenance and support, product claims, and any claims that the App infringes a third party's intellectual property rights. Apple has no obligation to provide maintenance or support services for the App.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.
